Terms of Service

These Terms of Service ("Terms") are an agreement between you and FairwaySplitter ("we", "us", "our") governing your use of the FairwaySplitter mobile application and this website (together, the "Service"). By creating an account or using the Service you accept these Terms. If you do not accept them, please do not use the Service.
1. Who we are
FairwaySplitter is operated from the United Kingdom. You can reach us at feedback@fairwaysplitter.app.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may only use it with the involvement of a parent or guardian. By using the Service you confirm you meet these requirements.
3. Your account
You are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly if you believe your account has been accessed by someone else. You may delete your account at any time from within the app, or via our account deletion page.
4. Subscriptions and payment
Some features are available only with a paid subscription. Subscriptions are sold and processed through the Apple App Store or Google Play, not by us directly. That means:
- Payment is taken by the app store using the payment method on your store account, and is confirmed at purchase.
- Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
- You manage and cancel your subscription in your Apple or Google account settings - cancelling cannot be done by us on your behalf.
- Refunds are handled under the policy of the store you purchased through. Where you have a statutory right to cancel or to a refund under UK consumer law, that right is unaffected.
We may change subscription pricing. If we do, we will give you reasonable notice and the change will not affect the period you have already paid for.
5. Free features and fair use
We offer a free tier and may change what it includes. Some features that cost us money to run - such as AI swing analysis - carry usage limits. We may apply reasonable limits to protect the Service and other users.
6. Acceptable use
You agree not to:
- use the Service unlawfully, or to harass, abuse or harm anyone;
- upload content you do not have the right to share, or that infringes the rights of others;
- upload content that is obscene, defamatory or otherwise objectionable;
- attempt to access accounts, data or systems you are not authorised to use;
- scrape, bulk-extract or resell our course data;
- reverse engineer the Service except to the extent the law permits.
7. Your content
You keep ownership of what you create in the Service - your scores, hole notes, swing videos, tracers and posts. You grant us a limited licence to host, store and process that content solely so we can operate the Service for you. If you choose to share content publicly in the app, you grant us the additional licence needed to display it to the people you shared it with.
We may remove content that breaches these Terms. Deleting your account removes your content as described in our Privacy Policy.
8. Accuracy of distances and course data
This matters, so we want to be plain about it. Our GPS distances, green positions, elevation figures and "playing-like" adjustments are estimates. They are derived from satellite positioning, openly licensed mapping data, third-party weather data and a terrain model, and they carry the error inherent in all of those.
- Course data may be incomplete, out of date or wrong. Greens get rebuilt and tees get moved.
- Playing-like distance uses empirical rules of thumb, not a physics simulation. It is a guide, not a guarantee.
- Handicap figures shown in the app are indicative only. They are not an official World Handicap System index and must not be used where an official index is required.
Do not rely on the Service for anything safety-critical, for navigation, or for competition scoring where a governing body requires an approved device. Always use your own judgement, and follow the rules of the competition and the course you are playing.
9. Third-party links and affiliate content
The Service links to third-party sites, including retailers. Some of those links are affiliate links, meaning we may earn a commission if you buy something. This never changes the price you pay, and it does not influence what we recommend. We are not responsible for third-party sites or their content.
10. Our intellectual property
The Service, its software, design, branding and the FairwaySplitter name are owned by us or our licensors. These Terms do not transfer any of that to you. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use.
Course geometry is derived in part from OpenStreetMap contributors and is used under the Open Database Licence.
11. Availability
We aim to keep the Service running but we do not guarantee it will be available without interruption. We may suspend, withdraw or change all or part of it, and we may need to do so at short notice for maintenance or security.
12. Our liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected.
Subject to that, we are not liable for loss that was not reasonably foreseeable, for loss of profit, opportunity or data, or for any loss arising from your reliance on distance, elevation, weather or handicap figures shown in the Service. Where we are liable, our total liability is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
13. Ending these Terms
You may stop using the Service and delete your account at any time. We may suspend or end your access if you materially breach these Terms, or if we stop offering the Service. If we end your access without cause while you hold a paid subscription, we will refund the unused portion of the period you paid for.
14. Changes to these Terms
We may update these Terms. If a change materially affects your rights we will give you reasonable notice in the app or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
